VALOR INMOBILIARIO DE REFERENCIA

La implementación del valor inmobiliario de referencia (VIR). Se trata de la modificación del Código Fiscal de la ciudad de Buenos Aire según la Resolución 67/2010 CABA, que establece un valor inmobiliario de referencia para todo acto, contrato u operaciones que sean gravables con el impuesto de sellos y que debe realizar un escribano. Esta actualizació comenzó a aplicarse según lo publicado en diez barrios, y en breve abarcará todos los demás. La Administración Gubernamenta de Ingresos Públicos(AGIP) actualizará anualmente los valores.
Vamos a poner un ejemplo:,si una unidad se vende por un precio de $ 480.000, al momento del otorgamiento de la escritura de venta se ingresa en la página de la AGIP para que informen el VIR. Para realizarlo se ingresa el número de partida del inmueble en cuestión, de lo que puede surgir No Disponible (en el caso en que en ese barrio no esté vigente todavía el VIR) o bien informa que el VIR es de $ 400.000, en cuyo caso el impuesto de sellos (2,5%) se abona sobre los $ 480.000, que es el precio de la operación y
además es el mayor valor”. Agrega que la AGIP puede informar que el VIR del inmueble en cuestión es de $520.000, es decir, superior al de la operación, en cuyo caso el impuesto de sellos se abona sobre este último valor, porque es el más alto a considerar.” Esa consulta tiene una vigencia de 10 días hábiles, plazo dentro del que se puede otorgar
la escritura; y si la misma se posterga por el motivo que fuere, se deberá solicitar nuevamente el VIR. Asimismo hay determinados montos de la escritura de compraventa que también se calcularán sobre este mayor valor. En la escritura se dejará constancia el monto del VIR o que No Dispone (porque el barrio no tiene vigente la resolución).
